Why isn't fireplace wood burning banned?

I used to love fireplaces myself until recently I developed allergies to it.. Last time my neighbors burned I had an intense headache that aspirin could fix.. this time I am having bad enough asthma to result in chest pains, a horrible headache, and benadryl isn't good enough bc I'm still having to breathe in smoke from INSIDE my own house.. Soon enough I will end up buying a $800 air filter but ppl die from asthma problems..this is serious. I don't know why there isn't laws against it. My friend's sister in law died at only 21 from an asthma attack, leaving behind a husband and three kids. I personally don't smoke, but I feel like there should be a ban on real fireplaces if you share a certain distance between you and your neighbor. Or if there is no other way to heat your house..such as gas and electricity cease to function during an emergency.
